Can someone charge you if you hack into their email? Is that considered Identity theft?
Theres this friend of mine who hacked into his bfs email and found out he was cheating. Now, he is getting back at my friend telling her that its identity theft and she will answer to the police.

It’s not identity theft unless she actually tried to pose as him, or use something of his trying to act on his behalf without his knowledge.
But she should know that it is a felony to hack into someone’s email account.

Any interference with another person’s email is illegal (internationally now), in the US it is a federal offence, anywhere it can carry a prison sentence. Identity theft means using another person’s identity, this is not the same, but is treated even more seriously.

Seems a natural reaction to me. Your friend wasn’t very smart. Good luck to him, if he can prove she did it. He would have to establish that no one else had access to the computer. That could be difficult. Tell her to take an asprin and lie down. It’s a soapie drama and nothing will happen.
